Terms of Use

§ 1 Scope and Provider
These Terms of Use govern the contractual relationship between Ömer Tos (acting under the business name 'TosLabs'), hereinafter referred to as 'Provider', and the users (hereinafter 'User') of the mobile applications provided by the Provider, hereinafter collectively referred to as 'Apps'. By installing and using the Apps, the User agrees to these Terms of Use.
§ 2 Subject of Contract
The Provider makes Apps available that support the User in the areas of time management, productivity, and health monitoring (e.g., alarm functions, sleep phase tracking). The Provider strives to ensure that the Apps are usable without interruption as far as possible. However, usability may be temporarily restricted due to technical faults, maintenance work, or further development.
§ 3 Basic Version and Pro Version
Basic Version: The Apps are generally offered as a free version ('Free'). This version may be restricted in its range of functions and contain advertisements. Pro Version: The User has the option of unlocking paid additional functions ('Pro Version'). This can be done as a one-time purchase or as a subscription. The specific scope of services of the Pro Version results from the product description in the Apple App Store at the time of purchase.
§ 4 Conclusion of Contract, Prices and Payment
Contractual Partner: The license agreement for the use of the App is concluded with the Provider (Ömer Tos). However, the purchase contract for the acquisition of paid content (Pro Version) and the financial processing are carried out via the operator of the App Store (Apple Distribution International). Prices: The prices displayed in the App Store are final prices. Payment is made via the User's Apple ID account. The terms of use and payment of Apple apply exclusively.
§ 5 Term and Termination of Subscriptions
Automatic Renewal: If the Pro Version is purchased as a subscription, the subscription is automatically renewed for the agreed term (e.g., 1 month or 1 year) unless it is cancelled in due time. Termination: The subscription can be cancelled via the Apple ID settings.
§ 6 Special Disclaimer for Alarm Function
The Provider assumes no liability for damages resulting from the failure of wake-up or alarm functions (e.g., missed appointments, travel), particularly if this is due to technical conditions of the end device (e.g., empty battery, 'Do Not Disturb' mode, silent mode, background restrictions of the operating system) or incorrect operation.
§ 7 User's Duty to Cooperate
The User undertakes not to use the App improperly, in particular not to circumvent security mechanisms or use the App for illegal purposes. The User is obliged to provide truthful information when creating an account and to keep their access data secret. The User is obliged to regularly perform data backups of their data stored in the App.
§ 8 Limitation of Liability
The Provider has unlimited liability in the event of intent, gross negligence and culpable injury to life, limb or health. In the event of slight negligence, the Provider is only liable for the breach of essential contractual obligations (cardinal obligations). In this case, liability is limited to the damage typical for the contract and foreseeable.
§ 9 Right of Withdrawal
Since the purchase of paid content takes place via the Apple App Store, the User is entitled to the statutory right of withdrawal vis-à-vis Apple. To withdraw a purchase or request a refund, the User must contact Apple Support directly (e.g., via reportaproblem.apple.com).
§ 10 Data Protection
The protection of your personal data is our highest priority. Information on the collection and processing of personal data can be found in our privacy policy.
§ 11 Final Provisions
The law of the Federal Republic of Germany applies. The EU Commission's platform for online dispute resolution can be found at https://ec.europa.eu/consumers/odr/. If individual provisions of these Terms are or become invalid, the validity of the remaining provisions remains unaffected.
